Photography Service Policy

Effective Date: August 18, 2026

Thank you for choosing DW Portrait. Please review the policy below. Its purpose is to provide a detail of our policies so that both parties have clear expectations.

1. Definitions

1.1. “Engagement” refers to the session day and any related photography services the Client is specifically commissioning the Photographer to perform.

1.2. “Photographer” means the photography studio identified above.

1.3. “Work” means all photographic images, digital files, prints, or other materials created by Photographer while performing the Engagement.

2. Copyright & Usage Rights

2.1. Creative Ownership: Work created during the Engagement is property of the Photographer and shall remain the Photographer’s property, as governed by copyright law.

2.2. Your Personal License: You're granted a non-exclusive license to use your images for personal, non-commercial purposes, printing, sharing, and displaying them however you like. Any commercial application requires a separate licensing arrangement, which we're happy to work out with you.

2.3. Corporate & Team Headshot License: For sessions booked for business purposes (including team, staff, or executive headshots), your license includes standard business use of the delivered images, such as your company website, internal directories, employee LinkedIn profiles, and general marketing materials, unless otherwise noted in your session agreement. Use in paid advertising, product packaging, or other expanded commercial use falls outside this license; reach out and we're happy to work out separate terms and pricing.

3. Booking, Payments, and Cancellations

3.1. Changes & Cancellations:

If cancellation is a result of client circumstances, please give us at least 24 hours’ notice.  If the cancellation occurs as a result of the photographer, you will be given the option of a full refund or a reshoot.

3.2. If any additional costs are to be incurred, this will be discussed before the Engagement.

4. Model Release, Privacy & Data Protection

4.1. Consent & Releases: For all Engagements, including those with minors, a model release must be signed. In the event of a minor, a parent needs to be present and sign for the minor.

4.2. Privacy Commitment: Your personal information stays private. We do not share it with anyone outside our studio without your permission.

4.3. Portfolio & Testimonials: We'd love to feature select images from your session in our portfolio, website, or marketing — but only with your explicit permission. We'll ask before using any photos publicly, and you're free to decline; if you do, those images stay private.

5. Delivery

5.1. Digital Delivery & Backup: Final images will be delivered securely via an online gallery. We will keep backup copies for 12 months following delivery.

6. Children Sessions

6.1. For sessions that include children, a parent or legal guardian must always be present.

7. Outdoor Sessions

7.1. Permits & Location Fees: For Engagements requiring fees (public parks etc), the Client is responsible for the cost of the fees.

7.2. Rescheduling: For outdoor Engagements, if weather compromises the Engagement, it will be rescheduled at the first available date to both Client and Photographer at no charge. This also includes health or disaster issues.

8. Additional Terms

8.1. Dispute Resolution: If a dispute arises between parties, mediation is the first step.  If that does not resolve the matter, it will be settled by the court system.

8.2. Governing Law: This policy is governed by the laws of the State of California.
